5. “Know-How” means all the ideas, designs, documents, diagrams, information, devices, technical and scientific data, secret and other processes and methods used by IZY Market in connection with this Portal, as well as, all available information regarding marketing and promotion of the Products and Services described in this Portal, as well as all and any modifications or improvements to any of them; 
6. “IZY Market” will include the employees, officers, advisers, service providers, suppliers and content providers of IZY Market; 
7. “Products & Services” products, devices, accessories, content, any other products or services which may be offered by IZY Market on the Portal; 
8. “Trade Marks” means those trademarks owned by companies within IZY Market and any other trademarks, designs, logos, style names and slogans which IZY Market either owns or has the right to use or any derivative service offerings of, and applications for, any of same;

The website izy.market is an online marketplace platform designed in a manner to connect the third party vendors and the users. The online marketplace platform provides access to the various categories of product offered by the third party vendors and facilitates services like Delivery services etc.

You hereby understand, acknowledge and accept that the online marketplace platform izy.market is only a mere facilitator

TERMS OF ONLINE MARKET PLACE PLATFORM

You understand, agree and acknowledge that the online marketplace platform will feature various third party vendors intending to showcase, sell their products. The Website shall however, take no responsibility in any manner for the content, products, descriptions, invoices generated and uploaded by the third party vendors.

4. The online platform izy.market shall not in whatsoever manner resolve or mediate any dispute or disagreement between the third party vendors and their customers

6. You understand, acknowledge and accept that the online platform provided through the Website izy.market shall not held liable in whatsoever manner for any but not limited to actions, commissions, misconduct, fraud or negligence of any third party vendor

7. All products come with a genuine brand warranty service offered by the brand’s authorized repair centre and official brand representative or importer in Mauritius.

CHARGES

Registration on the Website is free for users. izy.market does not charge any fee for browsing the Website. In particular, izy.market may at its sole discretion introduce new services and modify some or all of the existing services offered on the Website. In such an event izy.market reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be.

Changes to the Fee Policy shall be posted on the Website and such changes shall automatically become effective immediately after they are posted on the Website. Unless otherwise stated, all fees shall be quoted in Mauritius Rupees. You shall be solely responsible for compliance of all applicable laws for making payments to izy.market

No part of the Website and including content etc. shall be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including "mirroring”) to any other computer, server, Website or other medium for publication or distribution or for any commercial enterprise, without izy.market express prior written consent.

The Information provided by any user including images, content taken from internet shall be referred to as third party content and shall remain the intellectual property of the respective third party including individuals and/ entities and all information provided by you and/ any THIRD PARTY VENDOR, USER shall remain your Intellectual Property and/ or the intellectual property of the such THIRD PARTY VENDOR, USER. Although we try to ensure all information on the website is correct, there may occasionally be mistakes. We cannot be held responsible for website errors if they are genuine mistakes. We reserve the right to decline an order that is based on inaccurate information by either party.

OFFERS AND PROMOS

FREE GIFTS

All free gifts are subject to availability on a first-come, first-served basis, while stocks last. Once stocks are over, the free gift is no longer valid. 

IZY Market reserves the right to cancel promotions at any time without prior notice. 

If a Consumer returns any of the products within a promotional offer, they must also return the free item. 

Free gifts cannot be exchanged for cash. 

Free gifts are not available for hire purchase orders.

PAYMENT

The online marketplace platform provides a secured payment gateway for facilitating all payments on the website www.izy.market. In such an event, the terms of such payment gateway shall also be applicable. The online marketplace platform provides an option of mobile payment (Juice, Blink, Pop & Myt Money) and Bank Transfer for all and any products and orders through the website www.izy.market.

You shall have option to select a payment option

DELIVERY POLICY

All products purchased or ordered through the Website izy.market shall be delivered as per the delivery time and shall be specifically mentioned for each product which shall be mentioned on the Website.

A delivery fee inclusive of VAT is applicable as per below table for all deliveries payable by the buyer

In case of returns due to your fault, we will charge additional charges of Rs 200 to you. Such additional charges shall be intimated to You and You shall be responsible for payment of such additional charges

Should the product be out of stock  izy.market will immediately inform you by email or telephone. 

You understand that delivery of the ordered items shall occur only at locations within the Mauritian territory limits excluding Rodrigues and other Outer Islands. 

To ensure safe delivery, you must properly fill the delivery address, the mobile number and any specific instructions in the fields provided online. 

 izy.market Delivery Team will contact you directly to notify when the delivery of your order shall take place. 

For product(s) ordered that need to be delivered by external partners or Vendors,  izy.market shall request the full payment of the order prior to the delivery being done by the external partner or Vendor. 

IZY Market commits to deliver the ordered and available items within the chosen delivery option.  Should IZY Market not be in a position to deliver your orders within the given time-frame (for e.g in case of any force majeure),  izy.market Delivery Team shall contact the you immediately & notify you when the delivery of your order shall take place. 

In the event that you notice a change in the availability with respect to receiving your ordered products, you must call  izy.market on insert phone number to notify the Delivery Team as soon as you reasonably can. 

You need to present your identification document (National ID or Passport) to the  izy.market Delivery Staff before accepting the delivery. 

You must ensure and check that the product delivered is the right one and that you receive a Warranty Certificate, where applicable. A sales invoice indicating the amount paid will also be provided to you upon delivery. 

You will have to sign a Delivery Note acknowledging delivery of the products and need to check and ensure that your products are delivered sealed. For any issue regarding the delivered product, you will have to inform  izy.market.

 izy.market will not install any product(s) on behalf of the vendor.  Vendors selling on the IZY Market Platform will be responsible for installations if any. 

Once a product has been delivered to you IZY Market will not grant any refund. So it is your responsibility to ensure that the product is in good condition and meets your expectation at the moment of delivery 

In case of delivery by the Third Party Vendor, then the delivery details including but not limited to the estimated time of delivery, shipping, notifications etc. shall be provided by such Third Party Vendor. In such events, RHT Ventures LTD, website izy.market shall not be liable, responsible in whatsoever manner.

Once delivery has been made, we will not be liable for any breakages, nonconformity or shortages of the products ordered. 

All the products purchased or ordered through the Website shall be expedited based on the location entered by You while completing the purchase or order. We do delivery within 1 to 3 working days but it may delay depends on the availability of product.

NOTIFICATION OF DELIVERY

In case an order is placed through the website  izy.market, we shall send information to You through email, phone call and SMS (email id, mobile no provided by You during checkout or registration) notifying the details of delivery regarding your order.

CANCELLATION POLICY

You may cancel the order(s) placed through the Website izy.market before such order has been delivered. However, in case Your order has been expedited, but the order has not been delivered to You yet, then you may have the option to cancel Your order. In the event of Your order being delivered to You, no cancellation shall be possible.

However, in certain cases, cancellation of Your orders may attract payment of a cancellation fee and the same shall be indicated and mentioned for such specific products on the Website www.izy.market. In some events, you can cancel your orders without any cancellation fee for reasons including but not limited to any damaged products, order mismatch, wrong products, wrong product quantity, packaging issues etc. In case you wish to cancel your order, then you may cancel the same by placing a cancellation request and stating a reason for such cancellation. We shall process your cancellation request and shall refund the amount paid by You towards such order. However, such refund shall be in accordance with our terms and conditions.

In no event shall cancellation be permissible after delivery of Your order. You hereby agree that neither the website izy.market nor RHT Ventures LTD shall not hold any responsibility, liability for any cancellation related issues. No refund shall be initiated for orders cancelled after delivery as cancellation after delivery is not acceptable.

Cancellation by Us:

(a) We reserve the right to cancel your order at any time with or without prior notice if we have found that we have insufficient stock after checking on our live stock database

(b) We reserve the right to cancel your order if ever there was a mistake on our prices, wrong product or reference and defective product.

LEGAL ACTION AGAINST THE THIRD PARTY VENDOR, USER

In the event of any criminal act committed by any THIRD PARTY VENDOR, USERS, You may take direct action against such THIRD PARTY VENDOR, USERS as per the law being in force and in such cases www.izy.market, RHT Ventures LTD shall also be informed about the same,

In the occurrence of the any such event mentioned above, You shall not make RHT Ventures LTD, izy.market a party to such offence, as the user committing such act is individually and severally liable for any legal action whatsoever

VOLUNTARY CONSENT

You herein agree that the providing all the details including information is purely voluntarily and in no event shall the platform www.izy.market, RHT Ventures LTD be liable, responsible in whatsoever manner

LIABILITY DUE TO INTERNET CONNECTIVITY & NETWORK ISSUES
